LojaClimatiza is the online address of the store specialized in the sale of heat recuperators, salamanders, products for their maintenance and decorative items. LojaClimatiza sells its products, remotely, via the Internet (website or e-mail), via telephone or mail.

1. Object

The present General Conditions are presented in order to define the sales modalities between LojaClimatiza.com and its clients defined below. Becomes a customer under these general conditions, any natural person or legal entity that orders on the site www.lojaclimatiza.com whether a private customer or not.

1.1 Field of application

These General Terms and Conditions of Sale govern the sale of products from www.lojaclimatiza.com on the day of validation of the order. They apply whether the order was placed via Internet, e-mail, telephone or post.

1.2 Customer acceptance

The fact for the customer to validate his order automatically causes the express acceptance of these General Conditions of Sale. These conditions shall apply to the exclusion of all other conditions, unless otherwise agreed by both parties. The purchase by e-mail, by telephone, by fax or by post also implies the acceptance of the gifts. They can be read directly on our website. They can also be sent by e-mail, fax or post on request.

1.3 Modification of the General Conditions of Sale

LojaClimatiza reserves the right to change without prior notice the conditions of use or other regulations published on our website. Therefore, you should regularly consult the conditions of use since the continued use of the website presupposes the unreserved acceptance of the changes made to them and the submission to the most recent version. The version of this regulation does not have a precise date, the orders are thus managed by the General Conditions in use and therefore in force on the date of order.

LojaClimatiza strives to present the essential characteristics of products in the best way, in collaboration with manufacturers. A confirmation of technical data is always possible by contacting our Services via phone or e-mail. The products offered are in accordance with current European legislation and standards applicable in Europe.

1.5 User Manual

The LojaClimatiza makes every effort to provide, whenever possible, the user manual in the language of the consumer. Unfortunately, there are situations in which it may not be supplied in paper form, but only in computer format or downloaded directly from the Internet.

1.6 Prices

1.6.1 The sales prices indicated on the website are in Euros, with taxes and duties included in the retail prices. 

1.6.2 If the prices of our suppliers are changed in any way, the prices shown on the website are therefore liable to change at any time.

1.6.3 All prices shown are correct except for errors in data entry. If an order is placed for an item whose price is incorrect we reserve the right to cancel the order and refund the amount paid to the customer.

2. Value Added Tax (VAT)

2.1 Application

VAT applies to sales concluded with residents of the European Union. It does not apply to non-Portuguese EU companies with an intra-EU VAT number.

VAT does not apply to sales for export (Countries outside the European Union).

The invoice accompanies the goods and attests that VAT has been paid.

All prices include a VAT rate of 23% or 13%, depending on the law to which the products are subject.

3. Order

3.1 Order preparation

When you place your order through the website, you must fill out the form provided. Before validating the order you must reread the form to confirm the data. LojaClimatiza is not responsible for errors in sending e-mails, nor for errors in sending orders due to badly filled forms.

3.2 Order confirmation

The order confirmation is sent to the customer by automatic e-mail provided that the e-mail address given does not contain any errors.

3.3 Cancellation of order

Any customer can cancel his order at any time, unless it has been invoiced. In this case, if the customer does not really want the products ordered, he must accept the order and return it, at his own expense, that is, return it without opening it, mentioning "refused order". If the customer ordered via the website, you can cancel your order by phone, fax or e-mail. If the customer refuses to deliver the order, the amount of the initial shipping and return will be deducted from the amount of your refund.

3.4 Availability of products

Our product offers and prices are valid as long as they are visible on our website and at the limit of available stock. Further information can be indicated by phone, fax or e-mail.
If the LojaClimatiza cannot, for whatever situation, obtain a product from the suppliers within the time indicated, the customer will be informed of the status of the order via e-mail or telephone. In this way, the customer can choose to cancel their order or choose another product available. LojaClimatiza reserves the right to refuse an order.

4. Payment 
4.1 Form of payment

LojaClimatiza reserves the right to refuse to make a delivery or fulfill an order from a customer who has not paid in full or in part a product ordered.
All payments must be made within 3 working days after placing the order. After this period, the order will be cancelled.

4.3 Anti-Fraud Control
Uncovered cheques and all types of forged cheques or cards will be subject to immediate legal action.
4.4 Reservation of title
LojaClimatiza remains the owner of the products until their payment by the client.

5. Invoice
The order form placed online by the customer does not serve as invoice.
Whatever the type of order and mode of payment, the customer will only receive the invoice together with the goods at the time of delivery.

6. Deadlines
6.1 Deadlines for order preparation
Orders placed over the Internet are handled on a first come, first served basis from Monday to Sunday.
The processing time of an order varies according to the availability of each product.

6.2 Transport times
The time limits for transporting the goods shall be indicated by the carrier. These are transmitted to the customer as an indication, in working days, and also depend on the accuracy of the address provided by the customer on the date of the order as well as its availability for receiving the order. Failure by the carrier to meet these deadlines may not under any circumstances compromise the responsibility of LojaClimatiza. These deadlines are indicated to the customer when the goods are shipped.

7. Shipping
7.1 Packaging
The products to be shipped are packed and packaged so that they arrive at the place of delivery in perfect condition, always taking into account customer satisfaction.

7.2 Confirmation
If the customer placed his order on the site, an automatic order confirmation email will be sent. If the e-mail indicated by the customer is wrong the order will be processed after confirmation of your payment.

8. Delivery
8.1 Place of delivery
The orders are delivered to the delivery address indicated by the customer on the order form.

8.2 Absence on the day of delivery
You will be informed of the expected delivery date of your order. You must indicate a delivery address where someone is always present between 9am and 6pm, just like in the workplace. If the delivery does not take place, you will be informed of the date and time the carrier was present. There will be a further attempt at delivery the next working day.

8.3 Delivery time

8.4 Loss of orders
In this case, LojaClimatiza is obliged to respect the deadlines imposed by the carrier regarding the declaration of loss and reimbursement of the shipment. Therefore, the client must also wait for these deadlines:
- Therefore, you have a maximum of 30 working days from receipt of the e-mail confirmation of the order to declare it lost, at LojaClimatiza.com. Beyond this deadline no claim will be accepted.
- On the other hand, if the client has declared the loss of the order within the deadline, the LojaClimatiza must open the complaint process. In this case, it is possible that LojaClimatiza.com request the client to open the complaint process. The latter should provide the requested data as quickly as possible.
- Finally, the definitive answers regarding the investigations are given by the carrier within a period that varies from 1 to 3 weeks. There can be two types of situations: either the order is recovered and returned to the client according to normal procedures, or the order is declared lost by the carrier and LojaClimatiza informs the client to make a second shipment of the order or will be refunded the amount invoiced, as preferred by the client.

8.5 Receipt of order
We recommend that all orders delivered should be checked and controlled, and that the customer should make any notes on the condition of the product in the carrier's delivery note in case of partial or total deterioration.
Without the proper notes of the client the order can not be subject to subsequent dispute with the LojaClimatiza.
The verification of the product's condition is considered to have been made once the delivery note has been signed.
8.5.1 If the product is damaged, please photograph it and send us the photo to geral@lojaclimatiza.com within 24 hours so that we can activate the transport insurance.

8.6 Order content error
Upon receipt of the order by the client, the latter should indicate by phone, fax or e-mail to the LojaClimatiza the complaint of non-conformity of the products in type, quality or quantity compared with the data of the order placed.
The claim of non-conformity must be made within 24 hours of delivery of the order.
Claims not made in accordance with the rules set out above and within the periods indicated will not be accepted by LojaClimatiza.

8.7 Strikes or force majeure events
In case of strike of the carriers or other exceptional event that delays or prevents the delivery of the order, LojaClimatiza will inform the client of the delivery status.

9. Returns
9.1 Procedures and general conditions for returns
9.1.1 Conditions
The customer has the right to return the purchase within a maximum of 14 days from the date of delivery of the good/order. If the consumer chooses to be refunded, this refund will be made within 30 days following receipt of the product by LojaClimatiza. If you wish to make a return you must contact us in advance via email geral@lojaclimatiza.com, through the phone number 913 060 882 or you can go to our facilities accompanied, obligatorily, by the invoice of purchase and tell us whether you want to make the exchange of the good or be refunded.

9.1.2 Packaging status
Items returned must be in perfect condition, complete and properly packed in their original packaging and without any signs of actual use.
In case of withdrawal or error of the customer the shipping costs and return will be the entire responsibility of the customer.

9.1.3 Internal error
LojaClimatiza is responsible for return and reshipment costs if there is an internal error and the product sent does not correspond to the order. If you want to exchange for a different article, the shipping charges and the new shipment will be the responsibility of the customer.

9.1.4 Defects of origin
LojaClimatiza is responsible for the return and reshipment costs if the product is defective in origin. In this situation the exchange will have to be made for the same article. If you want to make the exchange for a different article, the costs of return and new shipment will be the responsibility of the customer.

9.1.5 Transport Damage
LojaClimatiza.com is responsible for the return and reshipment charges if the order was damaged during transport. In this situation the exchange will have to be made for the same article. If you want to make the exchange for a different article, the costs of return and new shipment will be the responsibility of the customer.
Important note: We recommend that you pay attention to the external condition of the packaging, as it may reflect possible damage to the product. At the time of delivery and in the presence of the carrier you should check the condition of the product before signing the Shipping Guide and thus accept the order. If the product is damaged, please photograph it and send us the photo to e-mailgeral@lojaclimatiza.com within 24 hours so that we can activate the transport insurance.
The verification of the product status is considered as done, once the Shipping Guide is signed.

9.1.6 Any packaging received at our premises without identification of the sender or sent for collection will not be accepted.

9.1.7 Sizes and colours
The items on this site have sizes and colors that are as close as possible to the genuine, but we remind you that in some cases they may not correspond 100% to reality. For specific cases, please check all information with the technical department at geral@lojaclimatiza.com before ordering, since returns for technical reasons will be the entire responsibility of the customer.

9.1.8 Custom goods
Returns, cancellations or refunds do not apply to personalized goods, a situation provided by law:
"Delivery of goods produced or ordered according to the consumer's specifications or clearly personalized cannot be returned".

9.1.9 Sending by withdrawal
In case of withdrawal or error of the customer the shipping costs and return will be the entire responsibility of the customer.

9.2 Decree-laws
The information regarding the consumer's right to withdraw from the contract (private customer) is described in detail in Decree-Law No. 143/2001 and Decree-Law No. 82/2008.
The general law of the Portuguese Civil Code, namely the rules set out in Decree-Law 67/2003, applies to the right of withdrawal from the contract by Companies, Institutions, Liberal Professionals and Businessmen on an individual basis.
